Effective date

On 30 September 2026 the Federal Register published a DHS final rule on EB-5 fees (91 FR 61940). The rule states it is effective 30 November 2026, and that any application, petition or request postmarked on or after that date must be accompanied by the fees established by the final rule. A USCIS alert dated 29 September 2026 likewise states that the new fees are designed to go into effect on 30 November 2026.

Selected filing fees in the regulatory text

In the rule’s fee schedule text, DHS sets among other amounts:

  • Immigrant Petition by Standalone Investor, Form I-526: US$7,615
  • Immigrant Petition by Regional Center Investor, Form I-526E initial filing: US$7,850
  • Form I-526E amendments: US$7,775

The same text states that each Form I-526 and each initial Form I-526E filing requires an additional USCIS EB-5 Technology Fee of US$75, and that this technology fee is included in the I-526 and I-526E initial amounts above. The preamble also records a 10 percent inflation adjustment to certain EB-5 Integrity Fund fees; the Form I-526E Integrity Fund fee is set at US$1,100.

Figures are government-published and were checked against the Federal Register text on 21 October 2026. Re-check the official table before relying on them.
